10-110-165 CONTRACTS AND INSURANCE LAW ...explore contract formation, breach of contract, defenses to contract, parol evidence rule, statue of frauds, and warranties. Examine insurance law including insurable interests, insurer's duty to defend, subrogation, and bad faith claims. (Prerequisite: 10-110-101, Paralegal Intro/Legal Ethics with a "C" or better)

What will I learn?

  1. Distinguish between the common law of contracts and contracts formed under the Uniform Commercial Code
  2. Identify the elements of a valid contract
  3. Differentiate between different contract classifications
  4. Examine issues related to the formation of common law contracts
  5. Identify the types of contracts which must be in writing under the Statute of Frauds
  6. Examines issues related to the performance and discharge of contracts
  7. Distinguish between equitable and legal remedies available to parties
  8. Develop a framework for drafting a contract
  9. Examine basic principles of insurance and the nature of risk
  10. Identify the duties and powers of the Wisconsin Insurance Commissioner
  11. Examine the insurer's duty to defend, subrogation issues, and bad faith claims
